This issue lies at the heart of the tension between public interest and individual freedoms, especially in tourist-heavy cities. According to the judges, <strong data-start=\"457\" data-end=\"517\">municipalities cannot ban or restrict short-term rentals<\/strong> carried out by private individuals, provided they meet certain conditions.<\/p>\n<p class=\"\" data-start=\"594\" data-end=\"908\">In <em data-start=\"597\" data-end=\"612\">La Repubblica<\/em>, <a href=\"https:\/\/qltlex.com\/en\/team\/nicola-romano\/\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"614\" data-end=\"652\">Nicola Romano <\/strong><\/a>and <a href=\"https:\/\/qltlex.com\/en\/team\/roberta-dercole\/\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"614\" data-end=\"652\">Roberta D\u2019Ercole<\/strong><\/a> explain that short-term leases managed by individuals, involving <strong data-start=\"718\" data-end=\"751\">no more than three properties<\/strong> and lasting <strong data-start=\"764\" data-end=\"797\">less than 30 consecutive days<\/strong>, do <strong data-start=\"802\" data-end=\"840\">not constitute a business activity<\/strong> and are therefore <strong data-start=\"859\" data-end=\"907\">not subject to local government restrictions<\/strong>.<\/p>\n<p class=\"\" data-start=\"910\" data-end=\"1289\">The Council of State acknowledges that this form of rental falls within the scope of property rights and contractual freedom protected by law, and that it does <strong data-start=\"1070\" data-end=\"1122\">not require special administrative authorization<\/strong>. As a result, <strong data-start=\"1137\" data-end=\"1201\">legal protections for private property owners are reinforced<\/strong>, especially those who have had to navigate restrictive and ambiguous local regulations.<\/p>\n<p class=\"\" data-start=\"1291\" data-end=\"1511\">This ruling represents a key legal reference for both future legislation and local policy development, as it clearly defines the scope of municipal authority concerning <strong data-start=\"1460\" data-end=\"1510\">short-term rentals and local government limits<\/strong>.<\/p>\n<p data-start=\"1291\"
