Corporate email and privacy: new guidance from the Data Protection Authority

The use of corporate email is once again under scrutiny following recent guidance from the Italian Data Protection Authority (Garante), raising concerns among businesses.

Carlo Cunto of QLT Law & Tax addressed the issue in an article published on Agenda Digitale, analysing the implications of the Authority’s position regarding workplace communications and employee privacy.

The analysis highlights how corporate email may, in certain circumstances, be considered a personal communication tool, with significant consequences for data protection and limitations on employer monitoring powers.

In this context, companies are required to review internal policies, monitoring tools and email management practices to ensure compliance with GDPR principles such as proportionality, transparency and data minimisation.

The article provides useful guidance on a regulatory framework that continues to evolve, requiring a careful balance between organisational needs and the protection of employees’ fundamental rights.
